Terms of service

These terms are an agreement between Log Studio Lab (operated by its founders as individuals, not a registered company, from Buenos Aires, Argentina, “we”) and the business that installs or uses Freebies Engine by Log Studio Lab or Experiment Engine by Log Studio Lab (“you”). The two products are separate services, each installed from the Shopify App Store; these terms apply to each one you use. If you accept them for a company, you confirm you can bind it. The services are for businesses, and you must be at least 18.

Freebies Engine by Log Studio Lab lets a merchant create promotions such as gifts, bundles, upsells and discounts on a Shopify store. Experiment Engine by Log Studio Lab lets a merchant run experiments on a Shopify store and measure the result. They work through Shopify's APIs, extensions and functions, so they depend on Shopify. We may improve, change or retire features, and we will give notice of any change that removes a core feature you rely on.

• Keep your sign-in details secure. You are responsible for what happens under your account and for the team members you invite.
• You confirm you have the right to connect the store and to grant the access the product asks for.
• Your use of Shopify remains under your agreement with Shopify. If Shopify suspends your store or the app, we may suspend the service to match.

• Paid plans are app subscriptions billed by Shopify, in US dollars, on your Shopify invoice, at the price and billing period shown on our pricing page and on the Shopify approval screen. We do not see or store your card details. Taxes are added where the law requires.
• Each store can have one free trial per product, with the length shown when you choose the plan. When the trial ends the subscription starts and Shopify charges you unless you cancel first. We keep a record of trials by store domain so a store cannot take a second one, even after it uninstalls.
• Fees are billed in advance through Shopify. You can change plan in the app or in your Shopify admin, or cancel at any time by uninstalling the app, which cancels the subscription and ends your access to the app. We do not refund or credit partial periods or unused time, except where the law requires it. Trials are free, and you are not charged if you cancel before the trial ends.
• If we charged you in error, contact us within 30 days of the charge and we will issue a refund or an app credit through Shopify.
• Free plans may have lower limits. If you go over a limit of your plan, we may stop new activity until you upgrade or reduce usage, and we will say so in the app.
• We may change prices with 30 days' notice before the next billing period. Shopify asks you to approve a price increase.

You keep all rights in your store, your offers, your catalog and your shoppers' data (“Your Data”). You give us a limited license to host, copy, process and display Your Data only as needed to provide the services, as described in our privacy policy and, for personal data we process for you, our data processing agreement. We do not sell Your Data.

We and our licensors own the services, including software, designs and trademarks. We grant you a non-exclusive, non-transferable right to use them while you have an active installation. If you send us feedback, we may use it without obligation. We may use data that does not identify you or your shoppers, combined across merchants, to measure and improve the services.

On uninstall, Shopify asks us to erase your store's data after about 48 hours, and we do. Before you uninstall, the Reset app data action in the app removes everything the product created in your store while it still has access.

You agree not to, and not to let others:

• break the law or Shopify's terms and policies, or use the services to sell anything unlawful;
• run promotions or tests that mislead shoppers or break advertising, consumer protection, pricing or sweepstakes law. You alone are responsible for the legality of your offers, their disclosures and their terms, and for the notices and consent your shoppers are owed;
• probe, scan or test the services for weaknesses except as our disclosure policy allows, or bypass limits or security;
• interfere with the services, overload them, or access data of another merchant;
• reverse engineer the services except where the law allows, or resell or white-label them without our written consent;
• upload malicious code or use the services to send spam.

We may suspend access to stop a violation or a risk to others, and will tell you why where we can.

The services rely on Shopify and on other providers listed on our subprocessors page. We are not responsible for third-party services or for outages or changes outside our control.

These terms apply while you have an active installation. You can end them by uninstalling. We may end or suspend the services for a material breach that is not fixed after notice, for non-payment, or if the law requires. Sections that by their nature should survive (ownership, disclaimers, liability, indemnity, governing law) do.

The services are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the services will be uninterrupted or error-free, or that any promotion or test will increase sales, margin or conversion. Test and offer results are statistics about your store, not guarantees.

To the fullest extent the law allows, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if told they were possible. Our total liability for all claims related to a product is limited to the amount you paid us for that product in the 12 months before the event that led to the claim. Some jurisdictions do not allow certain limits, so they apply only as far as the law permits. Nothing here limits liability that cannot be limited by law.

You will defend and compensate us against third-party claims arising from Your Data, your promotions and tests, or your breach of these terms, and we will tell you promptly and let you control the defense.

These terms are governed by the laws of the Argentine Republic. The courts of the City of Buenos Aires have exclusive jurisdiction, and you and we consent to them. This does not take away any mandatory consumer or merchant protection that the law of your own jurisdiction gives you.

We may update these terms. For a material change we will email the account owner and show a notice in the app at least 30 days before it applies. If you keep using the services after that date you accept the new terms; otherwise uninstall before then.

These terms, with the privacy policy, the data processing agreement and the pages they link to, are the whole agreement and replace earlier ones. If part is unenforceable the rest stays. You may not assign them without our consent; we may assign them in a merger or sale. Questions: support@marginlabs.app.
