Maine: an 8 percent prepared food rate, a rural majority and a mix and match plan for gift boxes

Maine taxes most retail sales at 5.5 percent, but Maine Revenue Services lists prepared food at 8 percent and lodging at 9 percent, and that second rate is the one a food gift box can run into. The statute defines prepared food as meals served on or off the retailer's premises, food and drinks the retailer prepares that are ready to eat, and all food sold at a location where retailer-prepared food is more than 75 percent of receipts, and it says prepared food does not include bulk sales of grocery staples. Maine is also unusually rural. In the 2020 Census files, 836,050 of its 1,362,359 residents, or 61.4 percent, lived in rural areas, which by our sort of the Census table is the second-highest share of any state after Vermont. For a Shopify seller, that makes delivery distance and a visitor season the planning facts. The Maine Office of Tourism's fall 2025 research estimated 2,616,400 visitors from September through November and found that 77 percent took part in food, beverage or culinary activities. This page gives the rates, the 100,000 dollar test for sellers outside Maine, the rural and visitor figures, two organizer-listed fall and summer events, and a mix and match plan for a box of Maine-made items. This is not tax advice; confirm with Maine Revenue Services.

Pick any three Maine-made items: a mix and match box plan

  1. Before you choose the items

Decide which items in the box could be prepared food under the statute: meals and food or drinks you prepare that are ready to eat without further preparation. Packaged goods made elsewhere are a different question. Maine Revenue Services lists prepared food at 8 percent against 5.5 percent for general sales, so write down which line each item is on before you set a single price.

  2. When you price the set

Use a fixed price for any three, and price it from the most expensive combination a shopper can pick, not from the average. If one item is prepared food and the others are not, the rate on the order can differ by item, which is another reason to keep the set's items in one rate category where you can.

  3. For the fall visitor weeks

The Maine Office of Tourism's fall 2025 report found that 77 percent of visitors took part in food, beverage or culinary activities and that over half enjoyed shopping. A box that a visitor can order from home after the trip matches that behavior. Keep the claim to what the report says, and do not quote visitor numbers as your own forecast.

  4. The first weekend of August and late September

The Maine Lobster Festival says it is held the first weekend of August, Wednesday through Sunday, and the Common Ground Country Fair held its 50th edition on September 25 to 27, 2026. Neither lists 2027 dates yet, so schedule your offers by month and tighten the dates when the organizers post them.

  5. Before you ship beyond the nearest hub

Because 61.4 percent of Mainers lived in rural areas in 2020, test your delivery promise to two rural ZIP codes before you advertise one price for the whole state. If you sell from outside Maine, count your Maine deliveries against the 100,000 dollar test each calendar year.

Questions merchants ask

What are Maine's sales tax rates in 2026?
Maine Revenue Services' rate table, in the column effective January 1, 2026, lists general sales at 5.5 percent, prepared food at 8 percent and rentals of lodging at 9 percent. The category that applies to a product depends on the statute's definitions, so check the product with the agency. This is not tax advice.
Is a gift box of Maine food prepared food?
The statute defines prepared food as meals served on or off the premises, food and drinks the retailer prepares that are ready to eat without further preparation, and everything sold at a location where retailer-prepared food is over 75 percent of receipts, and it excludes bulk sales of grocery staples. It does not mention gift boxes, so how a mixed box is treated is a question for Maine Revenue Services, not something this page can answer.
When does an out-of-state seller have to register in Maine?
36 M.R.S. 1754-B requires registration when gross sales from delivery into Maine in the previous or current calendar year exceed 100,000 dollars. Count your Maine deliveries each year against that figure.
How rural is Maine?
In the 2020 Census files, 836,050 of 1,362,359 residents lived in rural areas, which is 61.4 percent. By our sort of the 50 states' shares, only Vermont is higher at 64.9 percent. The number is a 2020 count, not a current estimate.
Are the 2027 Lobster Festival and Common Ground Fair dates known?
Not from the organizers' own pages when we checked on October 10, 2026. The Lobster Festival says it is held the first weekend of August, Wednesday through Sunday, and the fair's site announced September 25 to 27, 2026 for its 50th edition. This page lists both by month until the 2027 dates are posted.

Maine has 30,843 square miles of land and 1,414,874 residents, and 61.4 percent of the 2020 population lived in rural areas, so a delivery estimate is a distance question for most of the map. For a seller outside Maine the tax test is gross sales from delivery into the state above 100,000 dollars in the previous or current calendar year. For a Maine-based gift box the question is the rate: the statute's prepared food definition covers meals and retailer-prepared ready-to-eat food, while the Maine Revenue Services rate table puts that category at 8 percent against 5.5 percent for general sales.
