Alabama's two tax holidays, and a flat 8 percent rate for remote sellers

Alabama runs a sales tax holiday in February, the Severe Weather Preparedness weekend, which the Department of Revenue lists for Friday, February 26 through Sunday, February 28, 2027, more than four months before the back-to-school weekend in July. Both holidays suspend only the state sales tax unless a county or city votes to join, so the same 90 dollar flashlight can be taxed differently in two Alabama towns. For a store outside the state there is a second Alabama-only feature, the Simplified Sellers Use Tax, a flat 8 percent that an eligible remote seller can collect instead of working out state plus local rates. This page gives the verified dates and caps, the local participation rule, the flat rate and the remote seller test, and a bundle plan built from items the Department says are eligible. Severe Weather Preparedness sales tax holiday

From 12:01 a.m. on Friday, February 26 to midnight on Sunday, February 28, 2027, the Department of Revenue lists covered severe weather items as free of the 4 percent state sales tax. A covered item costs 94 dollars or less; a portable generator with its power cords is covered in a single purchase of 1,564 dollars or less. Local sales tax still applies in any county or city that has not adopted the holiday, and the Department publishes the list of those that have.

  • Batteries (AA, AAA, C, 6-volt, 9-volt) at 94 dollars or less
  • Battery or self-powered flashlights, lanterns and radios
  • NOAA weather radios
  • Tarpaulins, plastic sheeting and duct tape
  • Self-contained first aid kits, ice packs and non-electric coolers
  • Smoke detectors, carbon monoxide detectors and fire extinguishers
  • Portable generator with power cords, single purchase of 1,564 dollars or less

Watch out: The cap is per item, not per order, and the holiday covers the state tax only; a locality must adopt it at least 90 days before the weekend to exempt its own tax, which for 2027 puts the deadline near November 28, 2026 (computed from the rule). The Department's fact sheet and page do not say how a bundle that mixes eligible and ineligible items is treated, so keep every component under its own cap. This is not tax advice; confirm with the Alabama Department of Revenue.

A severe weather kit, priced to stay under the caps

  1. By November 2026

Pick the kit's components from the Department's list and price each one at 94 dollars or less: batteries, a flashlight, a NOAA weather radio, a first aid kit, a tarp. List the components and each price on the product page, because the Department's sources set a cap per item and say nothing about a bundle price.

  2. After November 28, 2026

Open the Department's participation list for 2027 and note which of your biggest Alabama delivery towns joined. Localities had to adopt the holiday at least 90 days before the weekend, so the list should be largely settled by then. Do not promise the shopper that local tax is waived: Athens joined and Alabaster did not, in the Department's September 2026 list.

  3. Friday, February 26 to Sunday, February 28, 2027

Run the kit during the holiday and say what it covers: the state sales tax on covered items, not the local tax everywhere. The Department's window starts at 12:01 a.m. Friday and ends at midnight Sunday, so schedule the offer to those times.

  4. Before your Alabama sales reach 250,000 dollars in a calendar year

Decide how you will collect: under the regular state and local rules, under the Simplified Sellers Use Tax at a flat 8 percent, or through a marketplace facilitator. The rule counts the previous calendar year's sales into Alabama and states no transaction count.

  5. Friday, July 16 to Sunday, July 18, 2027 (computed)

Plan a second holiday offer for back-to-school using the Department's rule of the third Friday in July. No 2027 fact sheet was out when we checked, so use the 2026 caps (156 dollars per article of clothing, 78 dollars per school supply item) only as a guide and re-read the 2027 sheet before you print any cap in your banner. Questions merchants ask

When is the Alabama severe weather sales tax holiday in 2027?
The Department of Revenue's 2027 fact sheet lists Friday, February 26 at 12:01 a.m. through Sunday, February 28 at midnight. The Department's page says the holiday falls on the last full weekend of February each year. Covered items are free of state sales tax; local tax may still apply. This is not tax advice; confirm with the Alabama Department of Revenue.
When is the 2027 back-to-school holiday?
The Department says the back-to-school holiday starts on the third Friday in July and ends at midnight on the following Sunday, which makes it July 16 to 18, 2027 (computed from that rule; the Department had not published a 2027 fact sheet when we checked). The Department adjusted the 2026 caps for inflation under Act 2025-309, so wait for the 2027 sheet before quoting one.
Does my city or county have to join the holiday?
No. A county or municipality may exempt covered items from its own taxes by adopting a resolution or ordinance at least 90 days before the holiday weekend, and the Department publishes the list of those that have told it. In back-to-school, Geneva County, Oxford, St. Clair County and Thomasville exempt only their regular tax and not the 1 percent education tax.
What is the Simplified Sellers Use Tax, and who can use it?
It is a program that lets an eligible remote seller collect, report and remit a flat 8 percent on all sales into Alabama instead of calculating state and local rates. The Department describes an eligible seller as one that sells into Alabama from outside the state, has no physical presence in it, and is not otherwise required to collect Alabama tax. Sellers apply and must be accepted before they collect.
Does a sales tax holiday apply to a sale under the flat 8 percent rate?
The Department's Simplified Sellers Use Tax page says the flat 8 percent applies to all sales made into Alabama and does not mention the holidays, so we cannot say how the two interact. Ask the Department's Sales and Use Tax Division before you advertise a holiday price to Alabama shoppers if you collect under the program.

Alabama has 50,645 square miles of land and a state rate of 4 percent, but the number a remote seller meets first is the 250,000 dollar test: Rule 810-6-2-.90.03 counts retail sales into the state in the previous calendar year and states no transaction count. A seller that passes it can use the Simplified Sellers Use Tax and collect one flat 8 percent for the whole state, in place of the regular state and local rates. Food carries a separate 2 percent state rate, which matters only if the catalog includes groceries.
